- Introduction
Tejo Ameno, Unipessoal Lda. (Hereinafter “GARDENIA“ or “Seller“), legal person 508358892, with headquarters at Rua Garrett, 61-6°, 1200-204. Lisboa, with the share capital of €5,000, is the legitimate owner of the official GARDENIA website and whose domain can be found at http://www.gardenia.com.pt

- Purpose
These Terms & Conditions exclusively govern all commercial transactions, including purchases and sales, made between the ‘Final Consumer’, the ‘Buyer’ and GARDENIA, the ‘Seller’, through the GARDENIA online store. Additionally, they govern the use of the website www.gardenia.pt by all visitors.
Browsing the website, as well as purchasing any product at http://www.gardenia.pt, constitutes agreement to these General Conditions of Use and Contracting.
A Final Consumer is considered any natural person who acts or buys for purely personal use, outside their business or profession, and therefore, without the intent to resell the items acquired from the GARDENIA online store.
GARDENIA reserves the right to change these Conditions of Use and Contracting without prior notice, as well as to modify at any time the information and commercial offer presented on products, prices, promotions, commercial conditions and services. Any such change will always be published on the website www.gardenia.pt.Any new rules or changes to the Terms & Conditions shall be binding on all Users as soon as they are made available on the website www.gardenia.pt.
- Online Ordering
An active email address is required to order on www.gardenia.pt. After choosing the item(s), click on "Add to Shopping Cart".
Upon finalising the purchase, the Final Consumer will receive an email confirming receipt of their order and its details. We suggest printing or downloading this copy for future reference. In the event that any information is incorrect, they can immediately request a correction or even the cancellation of the purchase.
A purchase will be finalised when the confirmation appears on the screen.
The Final Consumer may view their purchase details in their online store account, if they decide to register as a GARDENIA Customer. This information is kept confidential in our store, in accordance with our Privacy Policy.
In case of non-confirmation of payment or non-compliance with these General Terms and Conditions of Sale, GARDENIA reserves the right not to accept your order, or to cancel it totally or partially, even after its automatic confirmation.

- Shipping/ cancellation of order
GARDENIA only processes orders placed by a customer once payment has been confirmed; therefore, the Seller cannot guarantee the availability of the items until the beginning of such processing.
The item(s) will be shipped within three (3) business days.
Please note that the estimated time for shipping depends upon the shipping carrier selected and the order’s destination. GARDENIA will not be responsible for the failure or delay in performance of any delivery obligations resulting from an event of unforeseeable— that is, an event, act or omission, beyond its reasonable control.
GARDENIA only ships orders on business days. Thus, when estimating the delivery time of orders, weekends or public holidays are not counted. Any delay in the shipment of items, compared to the estimate of the dates presented, does not entitle the customer to compensation.
A delivery is considered complete, or a product delivered, once the delivery receipt has been signed at the agreed address.
It is possible to request changes or cancel the order by email (orders@gardenia.com.pt) at any time before payment is made.
If the Final Customer wishes to make a purchase and their shipping destination is not included on our shipping list, they can email us at "orders@gardenia.com.pt" or contact us via chat. Once they let us know which item(s) they want, we will get back to them with the associated shipping costs.
- Products availability and order refusal
GARDENIA may decline to validate an order if there is insufficient payment authorization,if the order is incomplete or incorrect, or if the ordered items are no longer in stock. In any such event, GARDENIA will notify the Final Consumer via email that the sales contract has not been concluded and that the sale will not proceed, specifying the reasons why.
If the items ordered at www.gardenia.pt are no longer available at the time the order is processed, despite prior order confirmation, or when GARDENIA receives the order, the Seller will immediately inform the Final Consumer of their unavailability. This notification will be provided no later than 30 days after receipt of the order.
In the event that an order is placed and paid for, but the items thereafter become unavailable, GARDENIA will issue a refund for the unavailable items.
If an item is out of stock, a reservation can be made by emailing orders@gardenia.com.pt or calling +351 911 932 752 ( national mobile network call), from Monday to Friday, between 10:00 am and 6:00 pm. The Buyer will be informed of the restocking status within a maximum period of 10 business days.
GARDENIA reserves the right to refuse any order, regardless of the reason, free from liability for any damages or costs. Furthermore, GARDENIA reserves the right to cancel any purchase even after acceptance or confirmation particularly in the following situations:

The information contained in the invoice is incorrect or unverifiable;

The order is flagged by the website’s Security Systems as incorrect, irregular or fraudulent;

Payment of the order is not received within 48 hours following the acceptance of the order;

The order cannot be delivered to the address provided by the Final Consumer;

It is considered that the Final Customer lacked the legal capacity to place the order;

A manifest error occurs in the pricing presented on the product(s);

The order is suspected to originate from a reseller.

- Payment Conditions and prices
Item orders must be paid by bank transfer to the account indicated in the order receipt confirmation email, subject to stock availability.
Prices displayed on this website include VAT at the current applicable rate and are valid at the time of purchase. In the event of a product exchange, the price of the replacement product shall apply. Prices and specifications are subject to change without prior notice.
The Final Consumer must send proof of payment, indicating the order number to orders@gardenia.com.pt, within two (2) business days after payment.
Prices listed on www.gardenia.pt include Value Added Tax (VAT). Promotional offers on the website are valid from May 1, 2026, to June 30, 2026.
The total price indicated at checkout includes taxes and shipping costs.
Prices are stated in Euros and any change to the delivery country may impact pricing due to shipping costs.
Following the order, an invoice will be sent to the Buyer, alongside the ordered item(s), to the address indicated during the purchase process.
- GARDENIA online store and transaction security
The GARDENIA online store benefits from the latest and most robust security technologies available for encryption platforms. From the initial moment of transaction until the order is fully processed, all payment information provided is encrypted, and is never saved on any public server.
Although we make use of highly advanced encryption software, any payment transmitted over the Internet or via email carries implicit risks, particularly if the Final Consumer fails to take the appropriate precautions and adopt responsible security practices.
GARDENIA cannot be held liable for any damage resulting from the use of electronic means of communication, including but not limited to, damages resulting from failures or delays in the delivery of electronic communications, interceptions or manipulations of electronic communications by third parties, or by computer programs used for such communications or the transmission of viruses.
- Retention of Title and Exchange of items
GARDENIA retains the ownership of the products until full payment of the purchase price.
Items purchased online may be exchanged at any GARDENIA store, within fifteen (15) business days of receiving the item at the customer’s address, provided that:
- The item is in its original condition and packaging, as it was sent to the customer;
- The label or security seal is incorrect, or when the labels have been altered from their original state or damaged.
- The item shows no signs of washing or use;
- there is an error in the price quotation;
- If delivery cannot be made to the indicated address.
- Quality and Guarantee
The items commercialised on www.gardenia.pt may not exactly correspond to the actual product in terms of image and colours, mainly due to the internet browser and monitor used.
The Final Consumer has the right to return any defective or non-conforming delivered items.Returns may be made within fifteen (15) business days following receipt at the customer’s address. In the event of a justified return, the purchase price and shipping costs will be refunded. GARDENIA will only be responsible for the damages suffered by the Final Consumer in the event that such damages result from violations attributable to GARDENIA's contractual obligations to the Final Consumer, or in the event that the liability results from applicable legal law.
If the Final Consumer suffers damages in connection with the website’s activity, GARDENIA’s liability shall be limited to: damage to GARDENIA items, and reasonable and verifiable costs incurred by the Final Consumer by virtue of GARDENIA’s breach of these Terms & Conditions.
GARDENIA shall not be held liable for any damages caused to third parties resulting from the use of any of our products. GARDENIA shall also be exempt from liability for any damages incurred by the Final Consumer as a consequence of the improper use of our products.
GARDENIA shall not be held liable for damages resulting from inaccurate information on the website.
All items marketed by GARDENIA are in conformity with the Portuguese legislation and European Union regulations.
GARDENIA disclaims all liability in the event of a breach of the legislation of the country of delivery. It is incumbent upon the Customer to check with local authorities the import or usage conditions of the items they intend to order.
- Intellectual and Industrial Property rights
All texts, comments, works, illustrations and images reproduced or displayed on www.gardenia.pt are strictly reserved under copyright as well as intellectual property rights worldwide.
Consequently, and in accordance with the Intellectual Property Code, the use of information is authorised for private purposes only, subject to any contrary or more restrictive provisions contained within the said code.
Any reproduction or display, whether in whole or in part, of the website www.gardenia.pt, or of any elements included therein, is strictly forbidden.
Company names, brands and distinctive signs reproduced on the website www.gardenia.pt are protected in conformity with applicable Industrial Property laws. The reproduction or display, whether in whole or in part, of any distinctive signs is strictly forbidden and shall be subject to prior written authorization from the owner of the GARDENIA trademark.
- Applicable law
These Terms & Conditions and any disputes arising from or relating to these general conditions, including their validity, the use of the website www.gardenia.com.pt, or any purchase made therein, shall be governed by Portuguese Law.
In the event of a dispute regarding the interpretation or execution of these General Conditions and Terms of Sale, GARDENIA and the "Final Consumer" commit to seeking a fair and equitable amicable settlement, within a maximum period of 60 (sixty) days following receipt of the communication sent for this purpose by either party.
In the absence of an amicable solution, in accordance with the provisions of the previous paragraph, and in case of breach of these Terms & Conditions, both PARTIES agree that the Court of Lisbon shall have exclusive jurisdiction to settle any dispute, with the express waiver of any other forum.
